CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA

 ARSAL OTOMOTİV SANAYİ TİC. A.S. As ("Company"), we show maximum sensitivity to the security of personal data of our employees, customers, business partners and all other natural persons we have a business relationship with. With this awareness, as the Company, we attach great importance to the processing and preservation of all personal data belonging to our employees, business partners with whom we have contractual relation, in accordance with the Personal Data Protection Law ("KVKK") numbered 6698. We process your personal data as explained below, in accordance with the KVKK and within the limits prescribed by the legislation.

1. Collecting and Processing of Personal Data and the Purpose of Processing

Your personal data, depending on the condition of  the contract between you and our Company; It can be collected by means of automatic or non-automatic methods, verbally, in writing, digitally or electronically in workplaces and related fields. Your personal data can be processed by being created and updated as long as the contractual relationship or obligations that may arise from the contract continue or legal obligations.

Individuals' race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, costume and dress, association, foundation or union membership, health, sexual life, criminal records  and security measures, and biometric and genetic data of special nature are private personal data.

 In accordance with the Labor Law No.4857 and other legislation, Private Personal Data related to health, criminal conviction and security measures of employees who have a labor contractual relationship with the Company are collected and processed within the boundaries of legal obligations in accordance with the employment contract between you and the Company.

If your mobile phone, vehicle or computer are provided to you by Company, your personal data may be processed for maintenance, repair and efficiency purposes.

Your personal data collected, fulfillment of our contractual obligations, continuation of Company activities, regulation of work, fulfillment of employer responsibilities, job security, management, supervision and performance of work, fulfilling our responsibilities regarding public institutions and organizations, personal data specified in the KVKK for the purposes of employee safety, will be processed within the terms and purposes of the processing.

2. To Whom and For What Purpose the Processed Personal Data Can Be Transferred

Company could transfer your personal data, for the purposes; fulfillment of contractual obligations, continuation of Company activities, regulation of work, fulfillment of employer's responsibilities, job security, management, supervision and performance of work, fulfillment our responsibilities regarding public institutions and organizations, for the purposes of employee safety. Personal data could transfer including but not limited to the ones listed below; suppliers, business partners and business contacts, with police units, public institutions, relevant ministries and directorates; It can be transferred to public institutions and legal entities assigned pursuant to labor law and social security laws, to public institutions authorized by laws, within the framework of the personal data processing conditions and purposes specified in KVKK.

3. Method and Legal Reason for Collecting Personal Data

Your personal data, which all kinds of verbal, written, electronic or digital media, in line with the above-mentioned purposes, in line with the labor and social security laws and contractual rights and obligations, in accordance with the legislation, the Company's employment contract, service etc., is acquired in order to fulfill its obligations arising from contracts and laws completely and accurately. Your personal data collected for this legal reason can be processed and transferred within the scope of the personal data processing conditions and purposes specified in the KVKK, for the purposes specified in this text.

4. Rights of Personal Data Owner According to Article 11 of Personal Data Protection Law No.6698

As personal data owners, if you submit your requests regarding your rights to our Company in writing, our Company will finalize it within 30 (thirty) days at the latest within the periods specified in the Law after verifying your identity, depending on the nature of the request.

In this context, personal data owners;

• Learning whether personal data is processed,

• Requesting information if personal data has been processed,

Learning the purpose of processing personal data and whether they are used appropriately for their purpose,

• To know the third parties to whom personal data are transferred domestically or abroad,

• Requesting correction of personal data in case of incomplete or incorrect processing and requesting notification of the transaction made within this scope to third parties to whom personal data have been transferred,

• To request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear, despite the fact that it has been processed in accordance with the provisions of the KVK Law and other relevant laws, and to request the third parties to whom the personal data has been transferred,

• Object to the occurrence of a result against the person himself by analyzing the processed data exclusively through automated systems,

• In case of damage due to unlawful processing of personal data, it has the right to demand the compensation of the damage.
